We discussed the Fourth Amendment rationale for requiring a warrant, signed by a neutral magistrate. ICE has been quiet about this new rule in the wake of the disclosure of the memo, but it’s something we all need to be aware of. As things stand, they could use this procedure anywhere, not just in Minnesota and Maine, where the cameras are focused, but in other places where there might be less attention at the moment.
